Terms and ConditionsWe offer to purchase your property on the terms and conditions set out below. By sending us your property, you accept these terms and conditions. We do not provide a gold valuation service. The terms and conditions below are legally binding on you as a customer in relation to the potential sale of any items (the "Property") which you send to Sigma Response Limited ("Postal Gold", "we" or "us"), registered office at Third Floor, Exchange House, 54-58 Athol Street, Douglas, Isle of Man, IM1 1JD (no gold is processed or stored at this address). 1. Requirements for Use You warrant to Postal Gold that - 1.1. you are at least eighteen (18) years of age; 1.2. You are resident in the United Kingdom; 1.3. you are an individual who under this contract is not acting for the purposes of your trade, business or profession; 1.4. you have good and marketable title to the Property; 1.5. the Property is sold free of all liens, encumbrances, liabilities, and adverse claims of every nature and description whatsoever; 1.6. the Property is not from, or the result of, illegal activity in any part of the United Kingdom or any other country; 1.7. any transaction initiated by you will not cause Postal Gold to be in violation of any anti-money laundering, anti-terrorism, or other applicable law of any part of the United Kingdom or any other country; 1.8. you are the actual legal owner of and have full authority to sell the Property to Postal Gold (Postal Gold may, but shall not be required to, ask you to provide documentation or other proof of such ownership); and 1.9. you are acting on your own behalf and not as the agent or representative of another person. 2. Shipping and Insurance 2.1. All Property sent to Postal Gold by you must be sent in the provided packaging (the "Gold Kit"). The tracking applications of the third party carrier, Royal Mail, will be the sole proof that the Property was mailed to Postal Gold. 2.2. By using the Gold Kit, the Property will be insured for five hundred pounds (£500) by Royal Mail. You must hand in the provided Royal Mail special delivery envelope at a Post Office branch or to your collection driver to get a signed receipt as proof of posting and to be covered by the pre-paid insurance. If you wish to send Property to Postal Gold with a total value in excess of five hundred pounds (£500), you may divide the Property between more than one Gold Kit, each Gold Kit having a separate insurance value of five hundred pounds (£500). 2.3. In the event your Property is lost or stolen prior to reaching Postal Gold you must make a claim against Royal Mail. 2.4. 2.4 Postal Gold reserves the right to reject delivery of any package which appears to be damaged, opened, or tampered with on delivery. Any such item will be returned to you in accordance with section 9 without any further liability to Postal Gold. 3. Precious Metals, Possible Damage to Your Property, Precious and Semi-Precious Stones, Costume Jewellery and Hazardous Materials 3.1. Precious Metals Postal Gold purchases precious metals such as second hand jewellery for melting and refining, not for resale. Postal Gold does not purchase silver. Prices are therefore melt prices and based solely on the weight and carat grade contained in the jewellery, not on its design or sentimental value if resold intact. The prices we offer may therefore be lower than the potential resale value if sold intact. As Postal Gold is not offering a valuation service, it will only offer a single purchase price for all Property that is sent in a Gold Kit. 3.2. Possible Damage to your Property By sending us your Property, you accept that the process of determining a purchase price may involve: (a) placing certain acids on your Property and that this can leave permanent staining and/or deep scratches; and (b) separating different materials or carat grades in the items included in your Property (including but not limited to watches and items containing different materials or carat grades, stones or non-precious materials). Such items may be destroyed and are not recoverable intact if you decide to reject our purchase price for your Property pursuant to section 7.1. 3.3. Precious and Semi-Precious Stones Postal Gold does not purchase precious or semi-precious stones; therefore, you must remove any precious or semi-precious stones from your Property prior to shipping of your Property to Postal Gold. Postal Gold will not be held responsible for loss or damaged precious or semi-precious stones contained in your Property that is sent to us for sale. 3.4. Costume Jewellery Postal Gold does not purchase costume jewellery or items not containing precious metals. After assessment, Postal Gold will send you a notification by email (if you have provided Postal Gold with an email address) or by post informing you that the Property does not contain precious metals. Please note that items not containing precious metals will not be returned by Postal Gold, except if you request via phone (0800 007 5807) or email (support@postalgold.com) that these items be returned to you within fourteen (14) days (inclusive of weekends and public holidays) of the date when we informed you that the Property does not contain precious metals. (For the avoidance of doubt, this period starts on the day we send the notification to you and not on the day you receive it. We strongly advise that you provide us with an email address so that you receive the notification as soon as possible.) If you have requested the return of Property which does not contain precious metals by phone or email (as above) within the prescribed period, it will be returned to you within ten (10) days of the date of your request. 3.5. Hazardous Materials You agree not to send in any hazardous materials irrespective of how they are contained or presented especially those containing: Arsenic, Beryllium, Bismuth, Cadmium, Mercury, Nickel, Lead, Antimony, Selenium, Tin, Tellurium or any other toxic elements. 4. Limitation of Liability 4.1. We will not be liable for loss or damage caused to your Property as described in clause 3, save where caused by our negligence. 4.2. This clause does not exclude or limit in any way our liability for: (a) Death or personal injury caused by our negligence; or (b) Fraud or fraudulent misrepresentation; or (c) Any other matter for which it would be illegal or unlawful for us to exclude or attempt to exclude our liability. 4.3. We are not responsible for indirect losses which happen as a side effect to the main loss or damage, including, but not limited to; (a) loss of income or revenue; (b) loss of business; (c) loss of anticipated savings; (d) loss of data; or (e) any waste of time. However, this clause 4.3 does not prevent claims for foreseeable loss of, or damage, to your physical property. 4.4. Without prejudice of any other of these conditions, any liability of Postal Gold to you shall be limited to the full market value by weight and carat of the unwrought precious metal comprised in the Property ("unwrought" means the precious metal in its native state, before being worked on). We will not be liable for loss or damage to materials contained in your Property that Postal Gold does not offer to purchase, including but not limited to silver, stones and non-precious metals. 4.5. If you wish to submit a claim for loss or damage to your Property to Postal Gold, you must notify us to request a claim form. In order to be processed, the claim form must be fully and accurately completed, signed and mailed to Postal Gold in accordance with the instructions. 5. Processing of Transactions 5.1. Once your Property has been received by Postal Gold, your Property will be assessed and a payment will be issued to you within twenty-four (24) hours of such assessment via the method you have selected (cheque or bank transfer). The day on which we issue payment is the "Payment Date". Postal Gold will send you a notification by email (if you have provided Postal Gold with an email address) or by post confirming that we want to buy the Property from you and the amount of your payment on the Payment Date. 5.2. Items are delivered to Postal Gold five (5) days per week, Monday through Friday, exclusive of UK bank holidays or weekends. In the event the twenty-four (24) hour period referred to above would extend into a weekend or holiday, your Property will be processed the first business day following the holiday or weekend. The twenty-four (24) hour period does not include the time it takes for your payment to be delivered to you. 5.3. The payment for your Property will include VAT. 6. Requesting a Quotation 6.1 If you would like to receive a quotation which states the amount that Postal Gold will be willing to pay for your Property you must specify your preferred method of receipt on the quotation request form contained in the Gold Kit and enclose it with your Property. Quotations will be sent via your preferred method of receipt within a reasonable period after Postal Gold receives the Gold Kit containing your Property. Your quotation shall remain valid for a period of fourteen (14) days from the date that it is sent to you (the "Acceptance Period" ). If you would like to accept the quotation and allow the transaction to commence in accordance with sections 5 and 7 you must reply to the quotation within the Acceptance Period. If you do not reply within the Acceptance Period the quotation will be deemed cancelled and Postal Gold will automatically return your Property to you within ten (10) days of the date of expiry of the Acceptance Period. 6.2 If you do not request a quotation the transaction shall commence in accordance with sections 5 and 7. 6.3 If you would like to contact a Postal Gold representative about your quotation during the Acceptance Period please do so via phone (0800 007 5807) or email (support@postalgold.com). Postal Gold may in its sole discretion record any telephone conversations in respect of quotations and if you orally accept our quotation during a telephone call then the transaction shall commence in accordance with sections 5 and 7. 7. Cancellation and Return of Property 7.1. If you decide to reject our purchase price, simply contact us via phone (0800 007 5807) or email (support@postalgold.com) within fourteen (14) days (inclusive of weekends and public holidays) of the Payment Date (the "Cancellation Period"; for the avoidance of doubt, this period starts on the day we send your payment to you and not on the day you receive it. We strongly advise that you provide us with an email address so that you receive notification of payment as soon as possible.) Should you reject our purchase price, you have an extra fourteen (14) days (inclusive of weekends and public holidays) to return the payment to our PO Box or bank account in addition to the Cancellation Period days (the "Payment Return Period"; note that the additional Payment Return Period only applies if you have contacted us (by phone or email, as prescribed above) within the Cancellation Period to reject the purchase price). If there is the possibility that receipt of the payment by you will be delayed by extraordinary delays in the postal service or acts, events, omissions or accidents beyond your reasonable control including extreme adverse weather conditions or any labour dispute including strikes or industrial action (collectively "Extreme Events"), Postal Gold may exercise its sole discretion to extend the Cancellation Period by a reasonable number of days. If you would like Postal Gold to consider granting you an extension of the Payment Return Period due to the occurrence of an Extreme Event you must notify Postal Gold of the delay that you envisage before the expiry of the Payment Return Period via phone (0800 007 5807) or email (support@postalgold.com). Requests for an extension of the Payment Return Period shall be assessed by Postal Gold on a case-by-case basis. If on a reasonable consideration of a request for an extension Postal Gold is satisfied that an Extreme Event has occurred that would have had an effect on the Payment Return Period Postal Gold shall not unreasonably refuse to grant a request for an extension. If Postal Gold extends the Cancellation Period or Payment Return Period, reference in these terms and conditions to the Cancellation Period or Payment Return Period shall be to the period as extended under this clause. Failure to contact us by phone or email within the Cancellation Period or, as the case may be, failure to return the payment to our PO Box or bank account within the Payment Return Period may result in the processing of your Property and once processed, the Property cannot be recovered. We therefore strongly advise you that you should ensure that you are available to receive your payment so that you may take any action required should you wish to do so. Payment must be returned in the same form as you received it (i.e. the original cheque or bank transfer with your name and order number as reference). Original cheques are to be returned at the following address: POSTALGOLD.COM, PO Box 65827, London, EC2P 2FN. Any costs incurred in returning the cheque or bank transfer (for example, postage) will be at your own expense. Please be aware that it may take up to three (3) working days for the payment to reach us. 7.2. We will return your Property within ten (10) days of the date we receive the returned payment in full from you. 7.3. Once you cash your cheque, you cannot cancel the sale of your Property pursuant to clause 7.1. 8. Ownership and Risk 8.1. Ownership of the Property will pass to us once the payment is issued by us. 8.2. If the Property is lost before it is assessed and you wish to make a claim against Postal Gold, you will need to provide evidence of the value of the property as well as the Royal Mail special delivery receipt from the Post Office. We strongly advise that you take a photo of your Property before sending it to us. 9. Return Insurance Liability 9.1. For the return of your Property, in accordance with sections 2.4 or 3.4 or 6.1 or 7.2, we will, in our sole discretion, choose the return carrier, insurance and receipt verification method for each transaction. We will insure your Property for up to five hundred pounds (£500). 9.2. You assume all risks (and title to the Property reverts back to the you) once any Property being returned is handed over by us to the carrier. 9.3. You must make any claim in relation to any defects (for example, missing items) within ten (10) days of receipt of the returned Property. In the event your Property is lost or stolen prior to reaching you, you must make a claim against the carrier. 10. Choice of Law These terms and conditions shall be governed by English law and be subject to the non-exclusive jurisdiction of the English courts. 11. Waiver Postal Gold's failure to exercise or enforce any right or provision of the terms and conditions will not be deemed to be a waiver of such right or provision. 12. Severability If any court or competent authority decides that any of the provisions of these terms and conditions are invalid, unlawful or unenforceable to any extent, the term will, to that extent only, be severed from the remaining terms, which will continue to be valid to the fullest extent permitted by law. 13. The Contracts (Rights of Third Parties) Act 1999 A person who is not party to these terms and conditions shall not have any rights under or in connection with them under the Contracts (Rights of Third Parties) Act 1999. 14. Assignment We may transfer all or any of our rights and obligations under these terms and conditions to another organisation, but this will not affect your rights under these terms and conditions. 15. Change of Terms and Conditions 15.1. Subject to clause 15.2 we reserve the right to change these terms and conditions from time to time. 15.2. The applicable terms and conditions for any particular transaction will be those terms and conditions which are sent to you with the Gold Kit, unless any change to these terms and conditions is required to be made by law or governmental authority
